2. Key terms
- Customer means an adult who places an order: a consumer, a business or a sole trader with consumer rights.
- Consumer means a natural person who buys for a purpose not directly related to their business or professional activity.
- Sole trader with consumer rights means a natural person running a business who concludes a contract directly related to that business, where the contract shows that it is not of a professional nature for that person, in particular in the light of the business activity entered in CEIDG (the Polish Central Register and Information on Economic Activity, Centralna Ewidencja i Informacja o Działalności Gospodarczej). Such a person has the consumer rights described in sections 8 and 9.
- Goods means Champagne and other products shown in the shop.
- Working day means a day from Monday to Friday, excluding public holidays.
3. Sales to adults only
The shop sells alcoholic beverages only to persons aged 18 or over. By placing an order, the Customer declares that they are an adult, that the goods will be received by an adult and that they are not buying alcohol for resale.
The courier or a person delivering on behalf of the Seller may ask the recipient for an identity document showing their date of birth. The goods will not be handed over to a person who does not show such a document, is a minor or is intoxicated. In that case the parcel is returned to the Seller and the Seller refunds the price paid for the goods; the Seller may deduct the cost of the failed delivery from the refund if the refusal to hand over the goods resulted from circumstances on the Customer's side.
4. Orders and conclusion of the contract
- Orders are placed using the form on the Checkout page. You do not need an account. The Customer may create a free account on the My account page or when ordering; the account shows the order history and saved addresses. The account can be deleted at any time by writing to kontakt@szampan.com.pl.
- To place an order, you must provide your e-mail address, first name and surname and delivery address, accept these terms and confirm that you are an adult. A phone number is optional; the courier will call it only if the recipient is not found at the address. The Customer who wants a company invoice ticks this in the form and gives the company name and NIP.
- Before placing the order, the Customer sees the total price of the goods, additional services and delivery. Placing the order with the “Place order and pay” button means an obligation to pay.
- After placing the order, the Customer receives an e-mail with a confirmation and the order number. The sales contract is concluded at the Point of Sale when the order is accepted for fulfilment, which the Seller confirms in that e-mail or in a separate message.
- The Seller may refuse to accept an order if the goods have run out, the details are incomplete or untrue, payment has not been received, or there is a reasonable suspicion that the order was placed by a minor. In that case the Seller refunds any payment taken without delay, and no later than within 14 days.
- The Customer receives the content of the contract (the order and these terms in the version in force on the order date) by e-mail, which allows it to be saved and reproduced.
5. Prices and payment
Prices in the shop are gross prices in zloty and include VAT. The delivery cost is shown in the basket and in the order form before the order is placed. When the price of a product is reduced, we show the lowest price from the 30 days before the reduction next to the reduced price.
Payment is made in advance by bank transfer to the Seller's account: Infinitum Retail Sp. z o.o., mBank S.A., account no. 73 1140 1977 0000 7953 2200 1001, with the order number as the payment reference. The Customer sees the transfer details after placing the order and receives them in the confirmation e-mail. Fulfilment of the order begins once the payment has been credited to the Seller's account; the dispatch time is counted from that day. If the payment is not received within 7 days of placing the order, the Seller may withdraw from the contract and will inform the Customer of this by e-mail.
We issue a receipt for every order or, at the Customer's request, a VAT invoice.
6. Delivery
We deliver only within Poland:
- Courier, anywhere in Poland, 19 zł. The courier usually delivers the parcel within 1-2 working days of dispatch.
Delivery is free on orders of 299 zł or more.
If anything delays dispatch or delivery, the Seller will notify the Customer without delay by e-mail or by phone. If the Seller does not deliver the goods within the agreed time, the Customer may set an additional deadline and, once it has passed, withdraw from the contract; these rights arise from Article 543¹ of the Civil Code (Kodeks cywilny).
Please check the parcel in the presence of the courier. It is best to record any damage visible on receipt in a damage report; however, this is not a condition for a complaint to be accepted.
7. Additional services
- As a gift. The Customer may give a delivery address other than their own; the gift recipient must also be an adult.
- Engraving on the bottle, 30 zł per bottle. The text, from 3 to 50 characters, is provided by the Customer when ordering, and the Customer is responsible for its content, including spelling mistakes. Engraving extends the order fulfilment time by 3 working days. An order with engraving requires payment in advance. The Seller may refuse to engrave content that is unlawful, infringes personal rights or encourages the consumption of alcohol. An engraved bottle is made to the Customer's specifications, so the right of withdrawal does not apply to it (section 8); the rights relating to non-conformity of the goods with the contract remain unaffected.
8. Right of withdrawal
Consumers and sole traders with consumer rights may withdraw from the contract without giving a reason within 14 days of the day on which they, or a third party indicated by them other than the carrier, took possession of the goods. To meet the deadline, it is enough to send the withdrawal statement before it expires. How to withdraw, the model withdrawal form and the rules for refunds and costs are set out on the following page: returns and complaints.
The right of withdrawal does not apply in particular to:
- engraved bottles and other goods made to the Customer's specifications (Article 38(1)(3) of the Consumer Rights Act (ustawa o prawach konsumenta)),
- goods supplied in sealed packaging which cannot be returned after opening for health protection reasons, if the packaging has been opened after delivery, which means in particular bottles with a broken closure or excise stamp (Article 38(1)(5)),
- alcoholic beverages whose price was agreed when the contract was concluded, which can be delivered only after 30 days and whose value depends on market fluctuations (Article 38(1)(7)), for example pre-release orders.
9. Complaints
The Seller is liable to consumers and sole traders with consumer rights for the conformity of the goods with the contract under the Consumer Rights Act, for 2 years from delivery. In relation to other businesses, liability under the statutory warranty (rękojmia) is excluded to the extent permitted by law, unless the parties agree otherwise.
Complaints are best sent to kontakt@szampan.com.pl, with the order number, a description of the problem and, in the case of damage, a photo. A complaint may also be sent by post to the registered office address. We reply within 14 days of receiving the complaint. Details: returns and complaints.
10. Electronic services
The Seller provides the following electronic services free of charge: the order form, the search function and suggestions, sign-up for messages about new bottles (newsletter), reminders about an unfinished order, back-in-stock notifications, the “Sommelier” chat and the request-a-quote form for businesses. These terms are the terms and conditions referred to in Article 8 of the Act on the Provision of Electronic Services (ustawa o świadczeniu usług drogą elektroniczną).
To use the shop, you need a device with internet access, an up-to-date browser (e.g. Chrome, Safari, Firefox, Edge) with cookies and JavaScript enabled, and an e-mail address. Providing unlawful content is prohibited.
The newsletter consists of e-mails about new bottles in the shop, sent with the Customer's consent. Each message contains an unsubscribe link; consent can be withdrawn at any time. The quote form for businesses allows you to attach a file with a list of addresses (CSV or XLSX, up to 5 MB).
Comments and complaints about electronic services can be sent to kontakt@szampan.com.pl; we reply within 14 days.
11. Business purchases
We accept business orders (e.g. gifts for clients and staff, delivery to multiple addresses) through the form on the For business page. The terms of such orders, including the invoice payment deadline, are agreed individually in the quote; matters not covered by the quote are governed by these terms.
12. Out-of-court dispute resolution
Consumers may use out-of-court complaint and redress procedures, in particular by applying to the Provincial Inspector of Trade Inspection in Warsaw (Wojewódzki Inspektor Inspekcji Handlowej w Warszawie) for proceedings before the permanent consumer arbitration court or for mediation, to a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) or to a consumer organisation. Information is available on the website of the Office of Competition and Consumer Protection (Urząd Ochrony Konkurencji i Konsumentów, UOKiK): uokik.gov.pl. Using these procedures is voluntary.
13. Personal data and cookies
The controller of personal data is Infinitum Retail Sp. z o.o.; the rules for processing data are set out in the privacy policy, and the use of cookies is described in the cookie policy.
14. Final provisions
The Seller may amend these terms for important reasons, in particular changes in the law, payment methods or delivery methods. Orders placed before an amendment are governed by the terms in their previous wording. These terms do not exclude or limit consumer rights arising from mandatory provisions of law. Matters not covered by these terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
